Title: Approval by the Board of Education of Amendment No. 2, Facilities Lease-Leaseback Agreement, for the Center at Foster Elementary School Project, between District and Overaa/Tulum/Eclipse JV, Oakland, CA, amending paragraphs 2.1.9 and 2.4.3 of Exhibit C to the Facilities Lease, adding an Owner's Contingency of One Million Eight Hundred Forty Thousand Seven Hundred and Four Dollars ($1,840,704.00) and, as a results of the added Owner's Contingency, the Maximum Guaranteed Price of the Agreement is increased by same amount, from $43,003,331.00 to $44,844,035.00. All other terms and conditions of the Agreement remain in full force and effect.
