Approval by the Board of Education of Amendment No. 2, Contract for Services (Contract No. PS-CHI-2324-225) by and between First 5 Alameda County, Alameda, CA, and the District, as follows;
1. By changing TERM from “July 1, 2023 to June 30, 2024” to “July 1, 2023 to June 30, 2027”,
2. Section III, TERMS AND CONDITIONS OF PAYMENT AND ACCOUNTABILITY REQUIREMENTS-- EXHIBIT B, is deleted and replaced in its entirety by:
The total amount to be paid to Contractor under this Agreement shall not exceed the sum of
$52,268,739 (FY 2023-27) and First 5 shall, under no circumstances, be required to pay in excess of
that amount. The not-to-exceed amount for FY 2024-25 is $14,497,296, which includes a baseline
budget of $12,022,896 and one-time costs of $2,474,400. Allocations and not-to-exceed amounts
for FY 2025-26 and FY 2026-27 will be based on the baseline budget established for FY 2024-25
($12,022,896). First 5 reserves the right to adjust the annual allocation based on the Contractor’s
program and budget performance. Budgets and allocations are subject to approval by the City of
Oakland, et seq. and
3.-11., incorporated herein by reference as though fully set forth;
and except for those changes expressly specified in this Amendment (No. 2), all other provisions, requirements, conditions, and sections of the Agreement shall remain in full force and effect, with this Amendment (No. 2) effective July 1, 2024.
