BOARD BYLAW 9131 - MEASURES B, J, Y INDEPENDENT CITIZENS' SCHOOL  
FACILITIES BOND OVERSIGHT COMMITTEE CHARGE OR RESPONSIBILITIES  
Purpose: With respect to Measure B (2006), Measure J (2012), and Measure  
Y (2020), to provide advice and  
recommendation to the District regarding the expenditure of funds for bond  
related projects, to actively review and report on the proper expenditure of  
taxpayers’ money for school construction and to take any necessary action in  
furtherance of its purpose including, but not limited to, receiving and  
reviewing copies of annual independent financial audits and deferred  
maintenance proposals, inspecting school facilities and grounds, receiving  
and reviewing cost-saving measures designed to reduce the costs of  
professional fees and site preparation. The Committee shall have the option  
to tour sites where Bond funds are being expended, with support from the  
Superintendent.

Plan - October 2024 - Facilities Planning and Management  
A continued discussion by and between Chief Systems and Services, or  
designee, and Measures B, J, and Y Independent Citizens’ School  
Facilities Bond Oversight Committee of Amendment No. 3, revisions to  
the Measure Y Spending Plan, as of October 2024, as reflected in Exhibit  
A, attached and incorporated herein by reference as though fully set forth,  
particularly but not limited to the following Matters:

An update on the Bond rating and the upcoming 3rd draw, and  
An update on OUSD plans of a proposed Bond Sale in January  
2026.

Bond Sale. Members were concerned about how the current structural deficit  
situation OUSD is in might affect the Bond Sale since the District rating with  
Moody and Fitch was downgraded.  
- Explanation of how Bonds are rated, what investors might look at, how they  
view risk. Also stated was that County Board of Supervisors must approve of  
OUSD request to sell prior to OUSD initiating the sale and also of refinancing  
of existing Bonds to get a better interest rate.  
- Master Plan draft will be presented to CBOC at January meeting. Preston  
stated that Facilities Department staff is more stable and cohesive because  
they have an active project planning team lead by a Planning Director. He  
said Facilities is performing full assessments on District Schools/properties  
which he said enables them to develop and address projects’ needs.  
- Vice Chairperson Nelsen asked CSS Thomas to confirm that no Measure  
BJY funds can be used or allocated to the District’s general fund.  
- Chairperson Gonzales discussed Board Meeting Item that was on  
December 10, 2025, Board of Education Regular Meeting Agenda. It stated  
Committees including BJY Committee were invited to present ideas to Board  
on addressing the General Fund Deficit. Chairperson Gonzales stated the  
December 10, 2025, Board of Education Regular Meeting Agenda was not  
posted in time for our BJY Committee to discuss and consider a  
recommendation. Chairperson Gonzales suggested BJY Committee  
Members reach out individually to the Board.

Facilities Bond Oversight Committee on the allocation of Fund 25 and  
Fund 35 to Measures B, J, and Y projects.  
Michael Ezeh, Account Manager, Facilities Planning and Management, gave  
a presentation on the allocation of Fund 25 and Fund 35 to Measures B, J,  
and Y projects. Michael Ezeh, and Chief Systems and Services (CSS),  
responded to comments and questions from the Committee.  
Discussion - Member Butler, Secretary Dawson, Chairperson Gonzales  
- The State reimbursement program that augments projects expenditures on  
school projects that qualify. Funds are applied for per project and state  
reimbursement for some construction costs comes years after.  
- Michael Ezeh explained that Developer fees come from the City of Oakland  
related to growth in attendance areas and can be spent on certain facilities  
and infra-structure projects.

- Chairperson Gonzales, Member Butler and Secretary Dawson visited West  
Oakland Middle School Window Replacement and Courtyard Enhancement  
Project. Project has been well received and has enhanced thermal comfort in  
classrooms.  
- Chairperson Gonzales, Member Butler and Secretary Dawson also visited  
the new Marcus Foster Administration (Cole) Building. Facility is very nice.  
Committee Members noted that there were very few staff occupying the work  
spaces/cubicles on this Friday (December 5, 2025) mid-morning visit.  
- The BJY Committee also requested of staff that they report to the BJY  
Committee as to what the ground floor is permitted for now and what is the  
process required to have the space occupied by OUSD or an outside entity.
